Privacy Policy
This Privacy Policy explains how IPTRADE COPIER, LLC (operating as 5MTrader, a product of API2 LABS) collects, uses, and protects your information.
What We Collect

Trading Account Data
5MTrader operates entirely in the cloud. To copy trades and provide live monitoring, history, and analytics, we collect and process:
- The trading accounts you connect (platform, broker, server, and account identifiers) — currently MetaTrader 5 and cTrader accounts
- The credentials or access tokens required to connect to those accounts on your behalf
- Your trades and performance data (orders, deals, positions) and the statistics we derive from them
What We DON'T Collect
We do not collect or have access to:
- The funds in your trading or broker accounts — we never hold, move, or withdraw money
- Your card details (these are handled entirely by Stripe; we don't store them)
- Data from your trading platform beyond what is necessary to copy trades and operate the service
How We Use Your Information
- Process payments and manage subscriptions
- Provide and maintain the service
- Provide technical support
- Send important service updates
- Monitor and improve service performance
- Detect and prevent fraud or abuse
- Comply with legal obligations
We never sell your personal information.

Marketing cookies (Meta Pixel) are only activated after you provide explicit consent through our cookie banner. You can withdraw consent at any time.

Sign-In with Google (Google User Data)
We offer "Sign in with Google" as an optional way to create and access your account. When you choose this option, we access a limited set of Google user data through Google's OAuth service. This section describes exactly how we handle that data.
Data Accessed
When you sign in with Google, we request only the basic, non-sensitive OAuth scopes (openid, email, profile) and receive:
- Your Google account email address
- Your name (given name, family name, and display name)
- Your profile picture (avatar URL)
- Your Google account identifier (the unique
sub/ account ID) - The OAuth tokens issued by Google for this sign-in (access token, ID token, token type, expiry, and granted scope)
We do not request or access your Gmail, Google Drive, Contacts, Calendar, or any other Google service data.
Data Usage
We use this Google user data solely to:
- Authenticate you and securely sign you in to 5MTrader
- Create and manage your account (link your Google identity to your 5MTrader account)
- Pre-fill your profile (your name and profile picture shown inside the app)
- Contact you about your account and service-related matters using your email address
We do not use Google user data for advertising, profiling, or any purpose unrelated to providing the service.
Data Sharing
We do not sell or rent Google user data, and we do not share it with third parties for their own purposes. Google user data may only be processed by the infrastructure and service providers we use to operate 5MTrader (see "Third-Party Services" above), strictly to deliver the service to you.
Data Storage & Protection
Google user data is stored in our secure database and protected with:
- Encryption in transit (TLS) and at rest
- Restricted, role-based access to personal data
- Secure storage of OAuth tokens, used only to maintain your authenticated session
- Monitoring for unauthorized access and regular security reviews
Data Retention & Deletion
We retain Google user data for as long as your account is active, and for up to 90 days after account cancellation, after which it is permanently deleted or anonymized.
You can request deletion of your Google user data at any time by emailing support@5mtrader.com; we will respond within 30 days. When you delete your account (or revoke our access from your Google Account permissions), we delete the associated Google user data and revoke the stored OAuth tokens.
Limited Use
5MTrader's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
Data Security
We protect your data with:
- Encryption in transit (TLS) and at rest
- Secure payment processing via Stripe
- Restricted access to personal data (role-based)
- Regular security audits
- Monitoring for unauthorized access
Your Rights
You have the right to:
- Access your personal information

After the applicable retention period, data is permanently deleted or anonymized.
International Data Transfers
We're based in the United States, and our hosting provider (Contabo) operates data centers in the European Union and other regions. Your data may therefore be transferred to and processed in the US and the EU. For EU/UK/Swiss residents, we rely on Standard Contractual Clauses (SCCs) as the legal mechanism for international data transfers.
Children's Privacy
Our service is not for anyone under 18. We don't knowingly collect information from minors. If we become aware that we have collected data from a minor, we will delete it promptly.
Changes to This Policy
We may update this policy. Material changes will be communicated via email at least 30 days before they take effect. Your continued use of the service after changes constitutes acceptance.
Terms of Use
These Terms of Use govern your use of 5MTrader services operated by IPTRADE COPIER, LLC (operating as 5MTrader, a product of API2 LABS).
By using 5MTrader, you agree to these terms. If you don't agree, don't use our services.
1. Service Description
5MTrader is a cloud-based copy trading platform for MetaTrader 5 and cTrader.
- Runs on our cloud infrastructure (no local installation)
- Copies trades between master and slave accounts in real time
- Includes live monitoring, trade history, and performance analytics
- Managed entirely via web dashboard
2. Eligibility
You must be:
- At least 18 years old
- Legally capable of entering this agreement
- Not prohibited from using the service under applicable laws
- Not located in a country subject to U.S. government sanctions
3. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the service for the duration of your active subscription.
You may not:
- Reverse engineer, decompile, or attempt to access our source code or infrastructure
- Share your account credentials with others
- Use the service for illegal activities
- Resell, sublicense, or redistribute access to the service
- Use automated tools to scrape, crawl, or interact with the platform outside its intended interface
4. Subscriptions and Payments
- Subscriptions renew automatically unless canceled
- Cancel anytime — access continues until period ends
- No refunds for current billing period (see Refund Policy)
- Payments processed securely by Stripe
5. User Responsibilities
You are responsible for:
- Correct account configuration
- All trading decisions made through the service
- Compliance with broker and prop firm terms
- Compliance with all applicable laws in your jurisdiction
- Maintaining account security and confidentiality of your credentials
- Ensuring your use does not violate any third-party agreements
6. Acceptable Use Policy
You may not use our service to:
- Engage in illegal activities or facilitate illegal trading
- Violate broker or prop firm terms of service
- Share your account credentials with unauthorized users
- Exceed your plan's account limits
- Use stolen or fraudulent payment methods
- Attempt to hack, disrupt, or compromise our services or infrastructure
- Abuse system resources in a way that degrades service for other users
- Use the service to manipulate markets or engage in market abuse
- Circumvent any rate limits, access controls, or security measures
- Interfere with other users' access to the service
Violations may result in immediate termination without refund.
7. Intellectual Property
All software, content, trademarks, and materials are owned by IPTRADE COPIER, LLC and protected by copyright, trademark, and other intellectual property laws. Nothing in these terms grants you any right to use our trademarks, logos, or branding without prior written consent.
8. Termination
By You: Cancel anytime. Access continues until period ends.
By Us: We may suspend or terminate your account immediately for:
- Violation of these terms or the Acceptable Use Policy
- Fraudulent activity
- Non-payment
- Extended inactivity (12+ months)
Effect: Upon termination, your connected trading accounts are disconnected from the service and your access is revoked.
9. Indemnification
You agree to indemnify, defend, and hold harmless IPTRADE COPIER, LLC (and its affiliates, including API2 LABS), its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the service
- Your violation of these terms
- Your violation of any applicable law or third-party rights
- Your trading activities and decisions
- Any content or data you provide through the service
10. Dispute Resolution
Contact us first: Before legal action, contact us at support@5mtrader.com to resolve disputes informally. We will attempt to resolve any dispute within 30 days.
Arbitration: If we can't resolve informally, disputes will be resolved by binding arbitration with the American Arbitration Association (AAA), not in court.
Exception: Small claims court disputes are allowed.
Class Action Waiver: No class actions. Disputes resolved individually only.
11. Governing Law
These terms are governed by Delaware law, without regard to conflict of law provisions.
Jurisdiction: New Castle County, Delaware (subject to arbitration provision above).
12. Force Majeure
Neither party shall be liable for failure or delay in performing any obligation under these terms due to causes beyond reasonable control, including but not limited to: natural disasters, acts of war or terrorism, epidemics, government actions, internet or infrastructure failures, power outages, or third-party service provider outages (including brokers, MetaTrader 5, or cloud providers).
13. Export Compliance
You represent that you are not located in, or a resident of, any country subject to U.S. government trade sanctions or embargoes (including but not limited to Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions). You agree to comply with all applicable export and re-export control laws.
14. Assignment
You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign our rights and obligations without restriction, including in connection with a merger, acquisition, or sale of assets.
15. Notices
To you: We may send notices via email to the address associated with your account, or through notifications on the dashboard. You are responsible for keeping your email address current.
To us: Legal notices must be sent to support@5mtrader.com with the subject "Legal Notice".
16. Changes to Terms
We may update these terms. Material changes will be communicated via email at least 30 days before they take effect. Continued use after changes means you accept them. If you do not agree with changes, you must cancel your subscription before the effective date.
17. Survival
The following sections survive termination of these terms: Intellectual Property, Indemnification, Dispute Resolution, Governing Law, Limitation of Liability (see Disclaimer), and any accrued payment obligations.
18. General
Entire Agreement: These terms, together with our Privacy Policy, Billing Policy, Refund Policy, and other legal documents on this page, constitute the entire agreement.
Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.
No Waiver: Our failure to enforce any right or provision doesn't waive that right or provision.
Affiliate Program Terms
These Affiliate Program Terms (the "Agreement") govern your participation in the 5MTrader affiliate and referral program (the "Program"), operated by IPTRADE COPIER, LLC (operating as 5MTrader, a product of API2 LABS) ("Company", "we", "us", or "our").
By accepting an invitation to the Program, claiming your affiliate account, generating or sharing a referral link, or accepting any commission, you ("Affiliate", "you", or "your") agree to be bound by this Agreement, our Terms of Use, Privacy Policy, and all other policies on this page. If you do not agree, do not participate in the Program.
1. Definitions
- Affiliate — a person or entity that has been admitted to the Program and assigned a referral code.
- Referral Code — the unique code assigned to you (for example,
JOHN) used to attribute customers to you. - Referral Link — any URL carrying your Referral Code, such as
https://5mtrader.com/?ref=CODEor the short linkhttps://5mtrader.com/r/CODE. - Referred Customer — a customer attributed to you under Section 5.
- Qualifying Purchase — a paid subscription invoice actually paid by a Referred Customer that is not refunded, reversed, charged back, or made during a free trial.
- Commission — the amount you earn on a Qualifying Purchase, calculated under Section 6.
- Attribution Window — the period (by default 90 days, configurable by us) during which a referral cookie remains valid.
- Sub-Affiliate — an affiliate enrolled beneath you in a multi-level structure (Section 8).
- Ledger — the record of your Commissions, adjustments, and payouts maintained by us.
2. Enrollment and Eligibility
- The Program is invitation-only. Participation begins when we create an affiliate account for you and you claim it (by setting a password or signing in) via the email we send you.
- Your affiliate account has a status: pending (invited, not yet claimed), active (able to earn Commissions), or paused/disabled (no new Commissions accrue).
- To participate, you must:
- Be at least 18 years old and legally capable of entering this Agreement;
- Provide accurate registration and payout information and keep it current;
- Not be prohibited from participating under applicable law; and
- Not be located in, or a resident of, any country subject to U.S. government trade sanctions or embargoes.
- We may accept or decline any applicant, and may suspend or remove any Affiliate, at our sole discretion.
3. License and Use of Brand
- We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use your Referral Links and the name "5MTrader" solely to promote the service and refer customers under this Agreement.
- You may not register, bid on, or use "5MTrader", our trademarks, logos, or confusingly similar variations in domain names, social handles, paid-search keywords, or ad copy without our prior written consent.
- You may not present yourself as the Company, as an employee or agent of the Company, or as authorized to make representations on our behalf.
- All goodwill arising from your use of our brand inures to the Company. This license terminates automatically when your participation in the Program ends.
4. Referral Links and Codes
- You may share your Referral Code in any lawful manner permitted by Section 11, including the query-parameter link (
?ref=CODE), the short link (/r/CODE), or by having a customer enter your code in the checkout discount field. - Referral Codes are case-insensitive when matched but are stored in a normalized form. We may issue, change, or revoke your Referral Code, and (where you have a customer discount) the associated coupon, at any time.
5. Attribution
Attribution determines which Affiliate, if any, is credited for a sale. It is resolved in the following order of priority:
- Referral link / cookie (first-touch). When a visitor first arrives through your Referral Link, a cookie is set that lasts for the Attribution Window. Attribution is first-touch: if a cookie already exists, a later link does not overwrite it. The cookie tags the subscription at checkout and, at signup, is recorded as a permanent referral record linking that customer to you. This referral-link attribution takes precedence over a manually entered promotion code.
- Manually entered promotion code (fallback). If there is no referral-link attribution, and a Referred Customer enters a promotion code mapped to your account at checkout, the resulting purchase is attributed to you.
- No attribution. If neither applies, no Commission is generated.
Additional attribution rules:
- One attribution per customer. Each customer is permanently attributed to at most one Affiliate (the first-touch referral). A promotion code later entered by a different Affiliate does not override an existing referral-link attribution, and does not change the customer's underlying referral relationship.
- No self-referral. You may not use your own Referral Code or promotion code on your own purchases or those of accounts you control. Self-referrals are void and may result in removal from the Program.
- We determine attribution using our own server-side records, which are final and conclusive absent manifest error.
6. Commissions
- Basis. Unless we state otherwise, Commissions are calculated as a percentage of the list price (subtotal) of the relevant invoice — that is, the price before any customer discount and before taxes, as recorded by our payment processor, Stripe. Customer discounts and taxes do not change this basis. Where a customer discount applies, its cost is borne by the Affiliate as described in Section 7.
- Commission rate. Your account has a single lifetime commission rate (which may be zero). The same rate applies to the Referred Customer's first Qualifying Purchase and to every subsequent renewal invoice, for as long as the subscription remains active and the customer remains attributed to you. There is no separate "first-payment" rate, and there is no fixed number of invoices or months after which Commissions stop.
- When earned.
- The first Commission is generated on the Referred Customer's first real paid invoice — never during a free trial. A subscription that is only in trial generates no Commission until a real payment occurs.
- A further Commission is generated on each subsequent paid renewal invoice, at the same rate, for the life of the subscription.
- Currency. Commissions are recorded in the currency configured on your account (USD by default).
- Exclusions. No Commission is earned on: free trials; invoices that are unpaid, refunded, reversed, or charged back; amounts that are not actually paid; or purchases made while your account is paused or disabled.
- Paused/disabled Affiliates. While your account is paused or disabled, no new Commissions accrue. Commissions already recorded follow their normal course under the Ledger.
7. Customer Discounts
- At our discretion, the Program may offer a customer-facing discount, delivered to each Affiliate as a real coupon and promotion code through Stripe.
- The discount percentage is set globally by us and is the same across the Program; it is not configured individually per Affiliate.
- The discount applies to the Referred Customer's first invoice only. It does not apply to renewal invoices.
- The Affiliate funds the discount. Because Commissions are calculated on the list price (subtotal) before the discount (Section 6), the cost of the customer discount is deducted from the Commission of the Affiliate who directly referred the customer (the lowest-level, or "leaf", Affiliate in any multi-level structure). It does not reduce the override Commissions of any upline Affiliate.
- When a visitor arrives through your Referral Link and a discount applies, the discount may be applied automatically at checkout. You may advertise the discount only as configured; you may not misrepresent its amount, duration, or conditions.
8. Multi-Level (Sub-Affiliate) Structures
- The Program may include multi-level (override) structures in which Sub-Affiliates are enrolled beneath you, and in which you may be enrolled beneath another Affiliate.
- Each level is paid directly by the Company through override Commissions. When a sale is generated, the Affiliate who directly referred the customer (the "leaf") earns a Commission at their own rate, and each Affiliate above them in the chain earns an override equal to the difference between their own rate and the rate of the Affiliate immediately below them, applied to the same list-price basis (Section 6). Each Affiliate's Commission is recorded separately on their own Ledger and paid to them directly. There is no single "top-level" Affiliate that receives the entire Commission.
- Because overrides are the difference between adjacent rates, a Sub-Affiliate's rate is set at or below the rate of the Affiliate who enrolled them, and at or above the global customer-discount percentage (Section 7). If your rate equals the rate of the Affiliate directly below you, your override on that sale is zero.
- The Company's obligation to each Affiliate is limited to that Affiliate's own recorded Commission. Any separate, private arrangement between Affiliates to further share or pass on Commissions is solely between those parties; the Company is not a party to it and has no obligation to honor, account for, or enforce it.
9. Commission Approval, Ledger, and Balance
- Each Commission is first recorded as pending. We review pending Commissions and may approve or reject them at our discretion, including to account for fraud, policy violations, refunds, or chargebacks.
- Your available balance is the sum of approved Commissions that have not yet been paid, less any adjustments and clawbacks.
- We may apply manual adjustments (positive or negative) to your Ledger to correct errors, reconcile disputes, or reflect agreed changes.
- The Ledger maintained by us is the definitive record of amounts owed. Reports shown in your dashboard are provided for convenience and may lag or be revised.
10. Payouts
- Payouts are manual. We do not use automated payout rails; the Company records each payout against your approved balance, after which the included Commissions are marked as paid.
- Minimum threshold. We may require your available balance to reach a minimum payout threshold before a payout is issued.
- Payout method and details. You are responsible for providing and maintaining accurate payout details (for example, PayPal, wire, or other agreed method). We are not liable for payouts sent to details you provided that are incorrect, outdated, or compromised.
- Timing. Payout timing is determined by us and may follow a regular schedule or be made on request once the threshold is met. Pending and rejected Commissions are not payable.
- Taxes. You are solely responsible for all taxes on your Commissions. We may require valid tax documentation (such as a Form W-9 or W-8) before issuing a payout, and may withhold amounts where required by law.
11. Refunds, Chargebacks, and Clawbacks
- If a Qualifying Purchase is later refunded, reversed, or charged back, the related Commission is void. We record a clawback (a negative entry) that reduces your balance.
- If the affected Commission was already paid to you, the clawback becomes a balance owed by you to the Company and is deducted from your next payout (or otherwise recoverable by us).
- We may reverse, withhold, or recover Commissions that we reasonably determine arose from fraud, abuse, error, or a violation of this Agreement.
12. Prohibited Conduct
You must not:
- Use your own (or controlled accounts') Referral Code or promotion code (self-referral);
- Engage in cookie stuffing, forced clicks, typosquatting, or any technique that sets attribution without a genuine, voluntary click;
- Bid on our trademarks or brand terms in paid search, or use misleading domains, ads, or social accounts that imply you are the Company;
- Send spam or unsolicited messages, or otherwise violate anti-spam laws (including CAN-SPAM and similar laws);
- Make false, misleading, or unauthorized statements about the service, pricing, discounts, or commissions;
- Guarantee or imply guaranteed trading profits or returns, or omit applicable risk disclosures (see our Disclaimer);
- Offer unauthorized cash-back, rebates, or other incentives that we have not approved in writing;
- Generate traffic or sign-ups through fraudulent, automated, incentivized, or non-genuine means;
- Promote the service on sites or channels that contain illegal, infringing, hateful, or adult content; or
- Take any action that harms the reputation of, or violates the rights of, the Company or any third party.
Violations may result in withheld or reversed Commissions, immediate termination, and forfeiture of your entire balance.
13. Advertising and Disclosure Standards
- You must comply with all applicable laws and advertising standards, including the U.S. FTC Endorsement Guides and equivalent rules in your jurisdiction.
- You must clearly and conspicuously disclose your affiliate relationship with the Company wherever you promote the service.
- Because the service relates to trading, you must not present it in a way that promises profit or minimizes risk. You must keep your claims accurate, current, and consistent with our official materials.
14. Relationship of the Parties
You are an independent contractor. Nothing in this Agreement creates an employment, partnership, joint venture, franchise, or agency relationship. You have no authority to bind the Company or make any representation, warranty, or commitment on its behalf. You are responsible for your own expenses, equipment, and taxes.
15. Confidentiality
Non-public information we share with you in connection with the Program — including commission rates, customer data, reports, and unreleased features — is confidential. You must use it only to perform under this Agreement, protect it, and not disclose it. You must handle any personal data you encounter in accordance with our Privacy Policy and applicable data-protection law.
16. Changes to the Program
We may modify the Program or this Agreement at any time, including commission rates, the Attribution Window, discounts, minimum thresholds, and eligibility. Material changes will be communicated by email or through your dashboard. Changes apply prospectively from their effective date; your continued participation after that date constitutes acceptance. Changes do not retroactively reduce Commissions already approved.
17. Term and Termination
- Either party may terminate participation in the Program at any time, with or without cause.
- We may suspend or terminate your participation immediately for any violation of this Agreement, suspected fraud, or where required by law.
- Effect of termination. Your license to use Referral Links and our brand ends immediately. Approved but unpaid Commissions remain payable subject to the minimum threshold, payout terms, and any clawbacks — except that Commissions arising from fraud or material breach are forfeited. No further Commissions accrue after termination.
18. Disclaimers and Limitation of Liability
- The Program is provided "as is" and "as available", without warranties of any kind. We do not guarantee any minimum number of referrals, conversions, or Commissions, or any particular earnings.
- To the maximum extent permitted by law, the Company will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenue, arising out of or relating to the Program. Our total aggregate liability arising out of or relating to the Program will not exceed the total Commissions paid to you in the three (3) months preceding the event giving rise to the claim.
19. Indemnification
You agree to indemnify, defend, and hold harmless IPTRADE COPIER, LLC (and its affiliates, including API2 LABS), and its officers, directors, employees, and agents, from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: your participation in the Program; your marketing, advertising, or representations; your violation of this Agreement or any applicable law or third-party right; and any arrangement between you and your Sub-Affiliates.
20. Governing Law and Dispute Resolution
- Contact us first. Before any legal action, contact us at support@5mtrader.com to resolve the dispute informally. We will attempt to resolve any dispute within 30 days.
- Arbitration. If we cannot resolve it informally, disputes will be resolved by binding arbitration with the American Arbitration Association (AAA), not in court. Small-claims court disputes are permitted.
- Class action waiver. No class actions; disputes are resolved individually only.
- Governing law. This Agreement is governed by the laws of the State of Delaware, without regard to conflict-of-law provisions. Jurisdiction: New Castle County, Delaware (subject to the arbitration provision above).
21. General
- Entire Agreement. This Agreement, together with the Terms of Use, Privacy Policy, and other documents on this page, constitutes the entire agreement regarding the Program and supersedes prior agreements on the subject.
- Assignment. You may not assign this Agreement without our prior written consent. We may assign it without restriction, including in connection with a merger, acquisition, or sale of assets.
- Severability. If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.
- No waiver. Our failure to enforce any right or provision does not waive it.
- Notices. We may send notices to the email associated with your account or through your dashboard; you are responsible for keeping your email current. Legal notices to us must be sent to support@5mtrader.com with the subject "Legal Notice".
- Survival. Sections on Confidentiality, Refunds/Chargebacks/Clawbacks, Disclaimers and Limitation of Liability, Indemnification, Governing Law and Dispute Resolution, and any accrued payment obligations survive termination.

Subscription Plans
5MTrader offers four plans. All plans include the full configuration (lot settings, symbol translation, reverse trading, exact match) — no feature gating between tiers.

All plans: Annual billing saves 20% (billed upfront).

Refund Exceptions
We MAY provide refunds at our discretion in these cases:
1. Billing Errors
Our mistake - We charged you incorrectly, twice, or after you canceled.
2. Unauthorized Charges
Your payment method was used without your authorization (requires proof).

Where required by law (e.g., EU consumer rights - see below).
EU Consumer Rights
14-Day Withdrawal Right (EU/UK/Swiss residents):
You can withdraw from your purchase within 14 days without giving a reason.
However: If you activate and use the service during the 14-day period, you acknowledge that you waive your right to withdrawal by beginning use of the digital service.

Plan Changes
Downgrades give you account credit (not cash refund). Credit is applied to future invoices automatically.
We do not provide cash refunds for plan changes. The proration system ensures you're not paying for unused time.

Limitation of Liability

Service Level Agreement (SLA)
This Service Level Agreement defines the service commitments for 5MTrader's cloud-based copy trading platform.
1. Service Availability
Uptime Commitment: 99.9% monthly uptime for the 5MTrader cloud copy trading service, including any dedicated VPS provisioned under a Private Server plan.
Uptime Calculation: Uptime % = ((Total minutes in month - Downtime minutes) / Total minutes in month) × 100
What counts as downtime:
- The copy trading engine is unable to process or execute trades
- The web dashboard is completely inaccessible
- API endpoints return errors for all users
- For Private Server plans: the dedicated VPS allocated to your subscription is unreachable due to issues on our infrastructure
What does NOT count as downtime:
- Scheduled maintenance (with prior notice)
- Issues with third-party services (brokers, trading platforms such as MetaTrader 5 or cTrader, user-supplied VPS providers)
- Force majeure events (see Terms of Use)
- Issues caused by user misconfiguration
- Network issues between user and our servers
- Degraded performance that does not prevent core functionality
2. Scheduled Maintenance
- We will provide at least 24 hours advance notice for scheduled maintenance via email and/or dashboard notification
- Maintenance windows will be scheduled during low-activity hours (weekends when markets are closed, when possible)
- Scheduled maintenance does not count toward downtime calculations

If we fail to meet our 99.9% uptime commitment in a calendar month, eligible customers may request service credits:

This SLA does not apply to:
- Accounts in violation of Terms of Use
- Free trial periods (if applicable)
- Features explicitly labeled as "beta" or "experimental"
- Issues arising from user-side infrastructure
8. Changes to This SLA
We may update this SLA with 30 days' notice. Changes apply to the next billing cycle after notification.
Data Processing Agreement (DPA)
This Data Processing Agreement forms part of the Terms of Use between you ("Data Controller") and IPTRADE COPIER, LLC, operating as 5MTrader, a product of API2 LABS ("Data Processor"), for the processing of personal data under the General Data Protection Regulation (GDPR) and other applicable data protection laws.
1. Definitions
- Personal Data: Any information relating to an identified or identifiable natural person
- Processing: Any operation performed on personal data (collection, storage, use, disclosure, deletion)
- Data Controller: You, the customer who determines the purposes and means of processing
- Data Processor: IPTRADE COPIER, LLC (operating as 5MTrader), which processes data on behalf of the controller
- Sub-processor: A third party engaged by the Data Processor to process personal data
2. Scope of Processing
We process personal data solely for providing the 5MTrader service, including:

To deliver the copy-trading and analytics service, we process the trading-account connection details and the trade and performance data of the accounts you connect. We do not provide trading advice, and we do not use your trading data or strategies for any purpose other than operating the service for you.
3. Obligations of the Data Processor
IPTRADE COPIER, LLC shall:
- Process personal data only on documented instructions from the controller
- Ensure that persons authorized to process data are bound by confidentiality obligations
- Implement appropriate technical and organizational security measures
- Not engage sub-processors without prior authorization (see Section 5)
- Assist the controller in responding to data subject requests
- Assist the controller in ensuring compliance with security, breach notification, and impact assessment obligations
- Delete or return all personal data upon termination of the service (within 90 days)
- Make available all information necessary to demonstrate compliance
4. Technical and Organizational Measures
We implement the following security measures:

6. International Data Transfers
Personal data may be processed in the United States and in the European Union (our hosting provider, Contabo, operates data centers in Germany and other regions). For transfers between these regions and the EU/UK/Switzerland, we rely on:
- Standard Contractual Clauses (SCCs) approved by the European Commission
- Sub-processors' own transfer mechanisms and data processing agreements (e.g., Stripe's and Contabo's)
7. Data Breach Notification
In the event of a personal data breach, we will:
- Notify the Data Controller without undue delay, and no later than 72 hours after becoming aware of the breach
- Provide details including: nature of the breach, categories and approximate number of data subjects affected, likely consequences, and measures taken or proposed
8. Data Subject Rights
We will assist you in fulfilling data subject requests, including:
- Right of access
- Right to rectification
- Right to erasure ("right to be forgotten")
- Right to restriction of processing
- Right to data portability
- Right to object
Requests should be directed to support@5mtrader.com. We will respond within 30 days.
9. Audits
Upon reasonable request and with at least 30 days' notice, we will make available information necessary to demonstrate compliance with this DPA. This may include providing security documentation, certifications, or summaries of third-party audits.
10. Duration and Termination
This DPA remains in effect for the duration of your 5MTrader subscription. Upon termination:
- We will delete your personal data within 90 days
- We will retain only what is legally required (e.g., billing records for tax compliance)
- We will provide confirmation of deletion upon request
